That you, as a lawyer for Mohammed Wolley ,the Complainant herein ,since 11th September, 2003 failed to refund to the Complainant an amount of USD 1,000,000 being payment in advance made by the complainant to you , towards the purchase of a property at Osu , which you have not procured.

That you, having assisted Mr. Francis Agyare, in Human Rights litigation in Accra, charged him GH₵50,000 which was excessive and an over-estimation of the services you rendered to him when you represented to him that you were offering pro bono legal services to him as a client.

Grave misconduct in a professional respect, contrary to Rule 6(a)(b) of the Legal Profession (Professional Conduct and Etiquette) Rules, 1969 L.I. 613.

PARTICULARS OF MISCONDUCT

That you as a Lawyer failed to seek the prior consent of the solicitor on record, Messrs Bentsi Enchill, Letsa & Ankomah before appearing on behalf of KASAPA Ltd in a pending case.

Grave misconduct in a professional respect , contrary to Rule 6 (1) of the Legal Profession (Professional Conduct and Etiquette ) Rules , 1969 L.I. 613.

 PARTICULARS OF MISCONDUCT
That you, having acted as Counsel for the Agbawe Family of Labadi in the disposal of its land , received in that capacity , an amount of GH₵4,000,000 on behalf of the said family, which you disbursed to third parties without issuing or obtaining any receipt and thus failed to account to the family for the money received.

COUNT 2: FAILURE TO KEEP CLIENTS’ ACCOUNT

Grave misconduct in a professional respect, contrary to Rule 6 (2)(a) of the Legal Profession (Professional Conduct and Etiquette ) Rules , 1969 L.I. 613.

PARTICULARS OF MISCONDUCT
In your dealings with the Agbawe Family of Labadi you failed to keep properly written books and accounts as was necessary to show all dealings with monies received on their behalf as their Lawyer.

COUNT 3: FAILURE TO DISTINGUISH OTHER MONIES HELD, RECEIVED OR PAID ON BEHALF OF YOUR CLIENTS

 STATEMENT OF MISCONDUCT
Grave misconduct in a professional respect, contrary to Rule 6(2)(b) of the Legal Profession (Professional Conduct and Etiquette) Rules ,1969 L.I. 613

PARTICULARS OF MISCONDUCT
In your dealings with the Agbawe family of Labadi you failed to distinguish monies held , received or paid to you on behalf of each separate client and to distinguish such monies from other monies held, received or paid to you on their behalf.

COUNT 4 : ENGAGING IN FRAUDULENT ACTS

STATEMENT OF MISCONDUCT
Grave misconduct in a professional respect , contrary to Rule 9(8) of the Legal Profession (Professional Conduct and Etiquette) Rules, 1969 L.I. 613.

PARTICULARS OF MISCONDUCT
In your dealings with the Agbawe Family of Labadi as their solicitor you issued a cheque in the sum of GH₵375,000 (Three thousand and seventy-five Thousand Ghana Cedis) to the said family which was dishonoured by your Bankers, the Standard Chartered Bank.
