LETTER OF REPRIMAND

I refer to the above subject matter.

The Disciplinary Committee of the General Legal Council at its meeting held on 27th January 2017, after a preliminary enquiry at which you were present, decided that you must be reprimanded for your conduct in this matter, to wit: As a member of an arbitration committee that was seeking to achieve a settlement of the dispute between Nana (Dr.) Adjorku Abora VII, the Complainant herein, and his alleged opponent, you subsequently accepted the brief of the Complainant’s opponent when the Complainant decided to pursue the matter in Court. You therefore placed yourself in a situation of conflict of interest.

By this letter, you are hereby reprimanded for your unacceptable and highly unethical conduct and warned to be more circumspect in future.

The General Legal Council will not approve of any such professional misconduct from you in the future.

SUSPENSION OF LAWYER MARTIN C. NWOSU FROM LEGAL PRACTICE

Please find attached a recent notice from the General Legal Council regarding the suspension of Lawyer Martin C. Nwosu for your attention.

You are kindly requested not to allow him appear before your respective Courts during the period of his suspension.

NOTICE IS HEREBY GIVEN that Lawyer Martin C. Nwosu is hereby suspended from legal practice for a period of six (6) months with effect from 27th April, 2017.

The above -named lawyer was formally charged under Rule 2 (2) of the Legal Profession (Professional Conduct and Etiquette) Rules, 1969 L.I. 613 that he; while acting as counsel for Mrs. Otua Swayne, prepared and caused to be executed a Contract of Sale for her without first sighting the Deed of Assignment although she had, in her instructions, informed him that the same had already been executed and in the custody of a third party subject to some other conditions which were to be met before the said Deed was to be released to the Assignor, thereby failing to protect his client’s interest in the sale of her property known as Plot No. 23, 1st Ringway Estate, Osu.

During the period of suspension, he shall not hold himself out as a Legal Practitioner or attend Chambers, or render, or purport to render any professional legal service to any person whomsoever, wheresoever.

The licence of Lawyer Martin C. Nwosu to practise for the next six (6) months is hereby withdrawn forthwith.
